1. Acceptance of Terms
By accessing or using the website located at https://unique-hardwood-floors.stri.ws/ (the "Site"), operated by Unique Hardwood Floors ("Unique Hardwood Floors," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms apply to all visitors and users who access or use the Site. If you do not agree to these Terms, please do not use the Site.
These Terms are in addition to any other agreement between you and Unique Hardwood Floors, including any written estimate, customer agreement, or flooring service agreement.
2. Description of Services
Unique Hardwood Floors is a flooring contractor based in Concord, California, serving the surrounding San Francisco Bay Area. We provide hardwood, engineered, laminate, and vinyl plank floor installation, stair installation, and sanding and refinishing services.
The Site is an informational website describing these services. The only interactive feature on the Site is a web chat widget, which allows a visitor to send us a message and, if they choose, to receive a reply by text message.
The chat widget is powered by GoHighLevel ("GHL"), a third-party customer relationship management platform. By using the chat widget, you acknowledge that your name, phone number, and message are transmitted through and stored on GoHighLevel's platform and infrastructure.
The Site does not offer user accounts, online payments, e-commerce checkout, newsletters, downloadable content, or membership areas.
3. Information Collected Through the Chat Widget
The chat widget collects only the following three pieces of information, all of which you provide voluntarily:
Your name
Your mobile phone number
Your message — a free-text description of your flooring inquiry
We do not collect your email address, street address, payment information, date of birth, government identification, or any sensitive personal information through the Site. A full description of how this information is handled is set out in our Privacy Policy.
4. Eligibility and Age Restriction
You must be at least 18 years of age to use the chat widget, submit your phone number, or consent to receive text messages from Unique Hardwood Floors. By using the chat widget and submitting your information, you represent and warrant that you are 18 years of age or older.
If you are under the age of 18, you are not permitted to submit any personal information, including your phone number, without the express consent and direct involvement of a parent or legal guardian who agrees to these Terms on your behalf.
Unique Hardwood Floors does not knowingly collect personal information from individuals under the age of 18. If we become aware that a person under 18 has submitted personal information without verifiable parental consent, we will take immediate steps to remove that information from our records.

5. Messaging Consent — How Consent Is Obtained
Unique Hardwood Floors sends text messages only to individuals who have knowingly and expressly opted in through the chat widget on our Site. We do not purchase, rent, borrow, import, or otherwise acquire phone numbers from any third party, lead vendor, affiliate, or shared database. We never message anyone who has not personally initiated a conversation with us.
Consent is obtained in exactly one way:
A visitor to https://unique-hardwood-floors.stri.ws/ opens the chat widget, enters their name, mobile phone number, and message, and voluntarily submits their phone number. The consent message reads:

Consent to receive text messages is not a condition of submitting a message, receiving a reply, obtaining a quote, or purchasing any service from Unique Hardwood Floors. You may contact us by telephone at (925) 408-3956 or by email at uniquefloors@att.net without agreeing to text messaging.
Your consent applies only to Unique Hardwood Floors. It is never shared with, transferred to, or relied upon by any other business.
6. SMS Communications — Description of Use Cases
All text messages sent by Unique Hardwood Floors are transactional and non-marketing. Every message relates directly to a conversation you started through the chat widget, or to a quote, appointment, or project arising from it.
By providing your mobile phone number through the chat widget and checking the consent box, you agree to receive text messages limited to the following use cases:
6.1 Reply to Your Chat Inquiry
A direct response to the message you submitted through the chat widget, including answers to your questions, requested pricing information, and requests for clarification about your project.
6.2 Appointment and Estimate Scheduling
Messages to schedule, confirm, reschedule, or remind you of an in-home estimate, site visit, installation date, or refinishing appointment.
6.3 Project Status Updates
Messages regarding the status of your active flooring project, including crew arrival times, material delivery, scheduling changes, weather or supply delays, and job completion notices.
6.4 Transactional Confirmations
Confirmations of appointments, deposits, invoices, and payments arranged directly between you and Unique Hardwood Floors.
6.5 Customer Support
Two-way conversational replies to questions, service requests, warranty inquiries, or other matters you initiate with us.
6.6 Service Notices
Occasional notices about changes to our business hours, contact information, or these Terms, where directly relevant to your existing inquiry or project.
7. No Marketing or Promotional Messages
Unique Hardwood Floors does not use text messaging for marketing, advertising, promotional offers, discounts, sales campaigns, newsletters, surveys, or lead generation of any kind.
We do not send recurring broadcasts. We do not send bulk or blast messages. We do not message individuals who have not personally opened the chat widget and opted in. Every outbound message we send is part of a one-to-one conversation with a person who contacted us first.
If our messaging practices ever change, we will register a separate campaign use case with the carriers and obtain new, separate consent before sending any promotional content.
8. Message Frequency
Message frequency varies and depends entirely on your conversation with us. A typical inquiry results in only a handful of messages. Because our messaging is conversational and reactive, we do not send messages on a scheduled or recurring basis.
9. SMS Opt-Out Instructions
You may opt out of receiving text messages from Unique Hardwood Floors at any time, at no cost, using any of the following methods:
Reply STOP to any text message received from Unique Hardwood Floors. You will receive one final confirmation message, and no further messages will be sent.
The following keywords are also accepted and will result in immediate opt-out: QUIT, CANCEL, END, UNSUBSCRIBE.

To re-subscribe after opting out, reply START or YES to any prior message from Unique Hardwood Floors, or contact us directly at uniquefloors@att.net.
Unique Hardwood Floors will honor all opt-out requests promptly and in compliance with applicable regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.
10. Message and Data Rate Disclosure
Message and data rates may apply to any messages you send to or receive from Unique Hardwood Floors. Rates are set by and vary according to your mobile carrier and your individual service plan. Unique Hardwood Floors has no control over and is not responsible for any charges applied by your mobile carrier in connection with text communications.

12. Carrier Liability Disclaimer / Message Delivery
Unique Hardwood Floors and its designated messaging service provider are not responsible for delayed, undelivered, misdirected, or incomplete text messages. Delivery of messages is subject to the effective transmission by your mobile carrier, and mobile carriers are not liable for any delays or failures in the delivery or receipt of any messages. Factors outside of Unique Hardwood Floors' control, including but not limited to network outages, carrier filtering, device compatibility issues, and technical failures, may affect the delivery of messages. Unique Hardwood Floors does not guarantee the delivery of any message and shall not be held liable for any loss or damage arising from failed or delayed message delivery.
13. Mobile Information Sharing Statement
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Your mobile phone number and SMS consent information will never be sold, rented, leased, or shared with any third party or affiliate for marketing or promotional purposes. This includes, without limitation, data brokers, advertisers, lead buyers, and any organization unaffiliated with Unique Hardwood Floors.
The sole exception is our designated messaging service provider, which processes and delivers text messages on behalf of Unique Hardwood Floors and is contractually prohibited from using your information for any independent purpose. No mobile information derived from SMS consent or opt-in will be used or shared beyond what is necessary to deliver the messaging services described in these Terms.
14. Privacy Policy
Our Privacy Policy explains how we collect, use, and protect the name, phone number, and message you submit through the chat widget. 15. User Obligations

You agree to provide accurate information, and to submit only a mobile phone number that belongs to you or that you are otherwise authorized to use.
16. Messages You Submit
The message you submit through the chat widget is used solely to respond to your inquiry, prepare a quote, and provide our services. We may retain your chat message and any subsequent text conversation in our customer records for service, quality, warranty, and legal compliance purposes.
You represent and warrant that any message you submit is lawful and does not violate the rights of any third party. Unique Hardwood Floors reserves the right to delete any submitted message at its sole discretion. We do not publish, republish, or use customer chat messages for advertising or testimonial purposes.
17. Intellectual Property
All content on this Site, including but not limited to text, graphics, logos, images, and photographs of completed work, is the property of Unique Hardwood Floors or its content suppliers and is protected by applicable intellectual property laws. You may not:
Reproduce, duplicate, copy, sell, or exploit any portion of the Site without express written permission from Unique Hardwood Floors
Use any meta tags or hidden text utilizing Unique Hardwood Floors' name or trademarks without express written consent
Frame or mirror any content from the Site on any other server or device
18. Third-Party Services and Links
The Site may contain links to third-party websites or services, including Google Maps and GoHighLevel. These third-party services have their own terms of service and privacy policies, and Unique Hardwood Floors is not responsible for their content, practices, or policies. Your interactions with any third-party site are solely between you and that third party.
GoHighLevel: The chat widget on this Site is powered by GoHighLevel. By using the chat widget, you acknowledge GoHighLevel's own Terms of Service and Privacy Policy, available at https://www.gohighlevel.com.
19. Compliance with Laws
You acknowledge that the messaging service must be used in compliance with all relevant laws, including those relating to privacy and telecommunications. Unique Hardwood Floors is committed to complying with all applicable laws and regulations governing electronic communications, including:
Telephone Consumer Protection Act (TCPA): We send text messages only to individuals who have provided prior express written consent through the chat widget. All messaging includes clear opt-out instructions, we honor consent revocation promptly, and we observe applicable calling and texting hour restrictions.
CTIA Guidelines: We adhere to the CTIA Messaging Principles and Best Practices, including proper disclosure of message frequency, applicable fees, and opt-out instructions, and we honor STOP and HELP keywords on all messaging traffic.
No Cold Texting: We do not engage in cold texting. We do not message any individual who has not personally submitted their mobile number through our chat widget and affirmatively opted in.
Email: We do not collect email addresses through the Site and do not send commercial email campaigns. Any email correspondence is a direct, individual reply to a message you sent us.
20. Children's Privacy
The Site is not directed to children under the age of 13. Unique Hardwood Floors does not knowingly collect personally identifiable information from children under 13. If you believe that a child under 13 has provided personal information to Unique Hardwood Floors, please contact us immediately at uniquefloors@att.net, and we will take steps to remove such information from our records.
21. Disclaimer of Warranties

UNIQUE HARDWOOD FLOORS DOES NOT WARRANT THAT:
THE SITE OR CHAT WIDGET WILL BE UNINTERRUPTED OR ERROR-FREE
DEFECTS WILL BE CORRECTED
THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
ANY PRICING ESTIMATE DISCUSSED BY CHAT OR TEXT MESSAGE IS FINAL OR BINDING PRIOR TO A WRITTEN ESTIMATE
This Section applies to the Site and its digital features only. It does not limit or modify any workmanship or materials warranty provided under a separate written service agreement between you and Unique Hardwood Floors.
22. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNIQUE HARDWOOD FLOORS, ITS OFFICERS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
YOUR USE OF OR INABILITY TO USE THE SITE OR CHAT WIDGET
ANY CONTENT OBTAINED FROM THE SITE
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
ANY THIRD-PARTY CONDUCT OR CONTENT ON THE SITE
ANY FAILED, DELAYED, OR UNDELIVERED TEXT COMMUNICATIONS
IN NO EVENT SHALL UNIQUE HARDWOOD FLOORS' TOTAL LIABILITY ARISING FROM YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100). THIS LIMITATION APPLIES TO THE SITE AND ITS DIGITAL FEATURES AND DOES NOT LIMIT LIABILITY ARISING UNDER A SEPARATE WRITTEN FLOORING SERVICE AGREEMENT.
23. Indemnification
You agree to indemnify, defend, and hold harmless Unique Hardwood Floors and its officers, employees, agents, and contractors from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:
Your use of and access to the Site or chat widget
Your violation of any of these Terms
Your violation of any third-party rights, including intellectual property or privacy rights
Your submission of a mobile phone number you are not authorized to use
24. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under or in connection with these Terms shall first be addressed through good-faith negotiation between the parties. If negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, seated in Contra Costa County, California, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect its rights. Nothing in this Section limits your right to bring a claim in small claims court.
25. Changes to Terms and Conditions
Unique Hardwood Floors reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following the posting of any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
26. Termination
Unique Hardwood Floors reserves the right to terminate or suspend your access to the Site or chat widget at any time, with or without cause or notice, including for violations of these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

28. Severability

29. Waiver
The failure of Unique Hardwood Floors to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision unless acknowledged and agreed to by Unique Hardwood Floors in writing.
30. Entire Agreement
These Terms and Conditions, together with the Privacy Policy and any other legal notices published by Unique Hardwood Floors on the Site, constitute the entire agreement between you and Unique Hardwood Floors with respect to your use of the Site and supersede all prior agreements, understandings, and representations.
